An in-depth assessment of arbitration contract clauses, the different types of
arbitrators that could be selected, and preparations for arbitration, including ethical
considerations such as conflicts of interest, biases, and unfair advantage.
Considerations regarding the use of a Special Discovery Master in arbitration of
federal court claims.

Panel 2: 2:45 pm – 4:15 pm
Analysis of arbitration before and during litigation, and best practices in
concluding arbitration, with an assessment of remote versus in-person arbitrations.
Discussion of ethical considerations including informed consent, arbitrator
transparency, and non-compliance with arbitration determinations. Considerations
regarding the impact of Special Discovery Masters on federal arbitrations.
