Delaware’s New Statutes for Life & Death Planning

In late 2025, two pieces of legislation became effective in Delaware directly impacting Delawareans in life and death planning. 1) The Uniform Real Property Transfer on Death Act, effective December 4, 2025, allows deed holders to transfer deeds on death via Transfer on Death Deed (TODD). The statute’s interface with the probate process, title insurance, and estate planning is complex and deep. 2) The Uniform Health-Care Decisions Act, effective September 30, 2025, made the most significant changes in 30 years to advance health-care decision making in Delaware, including permitting non-physician deciders of capacity and creating new Court of Chancery actions to challenge capacity determinations and health-care decisions.
