An in-depth assessment of mediation contract clauses, the different types of mediators that could be selected, and preparations for mediation, including ethical considerations such as conflicts of interest, biases, and unfair advantage.

Break: 10:30am – 10:45am

Panel 2: 10:45am – 12:15am

Analysis of mediation before and during litigation, and best practices in concluding a mediation, with an assessment of remote versus in-person mediations.  Discussion of ethical considerations including informed consent, mediator transparency, and non-compliance with mediated agreements.
